FSB are not allowed to certify WhatsApp and Telegram

After the adoption antiterroristichsky “Spring package” of issues on the implementation of the new laws there was a great number. In particular, the Internet has evolved to panic, it will not require any government certification of encryption that is used, for example, in such popular messengers like WhatsApp and Telegram, and do not forbid them for failure to comply with this requirement and will not start to penalize users of such services right and left (the penalty for physical persons from 3000 to 5000 rubles).

Minister of communications and mass communications of the RF Nikolay Nikiforov also noted that the law is unclear, questions regarding the certification of communication in which encryption is used, and regarding the transfer of encryption keys.
Such issues should clarify the FSB on behalf of the President of Russia, Vladimir Putin. And already done it – the FSB published on the website of a special notice clarifying the situation with certification.
Thus, the mandatory certification of encryption on the Internet is not required, unless we are not talking about emails involving state secrets. This applies to encryption in mobile devices, computers, base stations, telecommunication equipment. Thus, the users of instant messengers and smartphones as well as providers and manufacturers to fear the certification requirements should not, of course, if they do not pass through them state secrets.
Note that the basic requirements of the “Spring package” affecting the telecommunications area will come into force from 1 July 2018. Up to this period, the authorities should coordinate and solve a lot of issues regarding their implementation of these issues need to be resolved before 1 November 2016.
We will remind, among other things, the “Spring package” requires Internet companies and Telecom operators to store transferred between the user traffic, including content such as videos, up to six months, and the fact that the transfer of data between users – up to one year and three years, respectively. In addition, ISPs and Internet companies will be required to provide to the authorities to demand the keys to decrypt the transmitted user data.
